Aree's Stool: Court Bans Osun Governor from Installing Prince Oyelakin As Aree
An High Court in Osogbo has restrained the Government of Osun from issuing certificate, instruments and staff of office to one Prince Muritala Oyelakin as the Aree of Iree.
The court, presided over by Justice M.O Awe gave the retraining order following a suit filed by Oba Raphael Oluponnle Ademola, the Aree of Iree who was sacked by Governor Ademola Adeleke through an Executive Order.
In a Motion Ex-parte, Oba Oluponnle prayed the court for an order of interlocutory injunction restraining the government from issuing “certificate, instrument and/or staff of office” to Prince Oyelakin or taking further step in formally installing him as the new Aree.
The order read: “There is indeed an urgent need to maintain the status quo ante bellum pending the hearing and determination of the motion on notice for interlocutory injunction also filed in respect of same matter.
“Accordingly, the claimant/Applicant’s application succeeds and it is hereby ordered as prayed. And specifically, the 1st, 2nd, 3rd and 4th respondents are hereby restrained from issuing the 9th respondent (Prince Muritala Oyelakin) with a certificate, instrument and/or staff of office as the Aree of Iree, or taking any further step in formally installing him pending the determination of the motion on notice for interlocutory injunction filed in respect of the same subject”.
Recalled that Oba Oluponnle was appointed by the former Governor Gboyega Oyetola’s administration and presented with the Certificate and Staff of Office, but Governor Adeleke later issued an Executive Order that he should vacate the palace, without recourse to the fact that a case was still pending in court on the matter as at the time.
The government subsequently issued a White Paper nullifying the appointment of Oba Oluponnle and ordered that the case which was instituted against his appointment should be withdrawn before the commencement of a new process.
In violation of its said White Paper, the government subsequently instituted a fresh process of installing a new Aree without withdrawing the suit as spelt out in the said white paper, and the process produce one Prince Muritala Oyelakin.
